These Terms of Service ("Terms") govern your access to and use of the BRIGHTSHIFT website, services, and products. By using our website, requesting a quote, or placing an order, you agree to these Terms.

Bravo Apparel Pty Ltd (ABN 70 678 599 132) trading as BRIGHTSHIFT ("we", "us", "our").

1. About Us

BRIGHTSHIFT is an Australian-owned business providing custom dye-sublimated workwear polos and related apparel. All products are made to order with customer-supplied branding, artwork, or designs.

2. Eligibility

To place an order you must: - Be at least 18 years old, or placing an order on behalf of a business or organisation. - Provide accurate contact and shipping information. - Have the legal authority to agree to these Terms on behalf of yourself or your business.

3. Quotes

  • Quotes are valid for 30 days from the date issued unless otherwise stated.
  • Quotes are based on the specifications you provide. Changes to specifications may change the price.
  • Quotes are not binding orders — you confirm by proceeding to place an order.

4. Orders

Placing an order

Orders are placed through our website or by direct arrangement with our team. By placing an order, you confirm: - All information you provide is accurate. - You have the right to supply any artwork, logos, or designs you upload. - You have reviewed and agreed to these Terms, our Privacy Policy, Returns & Refund Policy, and Shipping Policy.

Order acceptance

An order is not accepted until we confirm acceptance by email. We reserve the right to refuse or cancel an order for any reason, including but not limited to: - Pricing errors. - Inappropriate, offensive, illegal, or copyright-infringing artwork. - Out of stock raw materials. - Suspected fraud.

If we cancel an accepted order, we will refund any payments in full.

Proof approval

  • After order placement, we produce a digital proof showing how your polos will be printed.
  • Production does not begin until you approve the proof in writing (email is sufficient).
  • You are responsible for reviewing the proof carefully — sizes, spelling, colours, placement, artwork quality.
  • Once approved, you cannot cancel for change of mind. See our Returns & Refund Policy for exceptions.

5. Pricing and Payment

  • All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.
  • Payment is due in full at order placement via Shopify Payments, PayPal, or other methods we offer.
  • We do not store full payment card details. Payment information is handled by certified payment processors.
  • Prices can change at any time but will not change after you place an accepted order.

6. Intellectual Property

Your artwork and logos

  • You retain all rights to any logos, artwork, designs, or intellectual property you supply to us.
  • You grant us a limited licence to use, reproduce, and print your artwork solely for the purpose of fulfilling your order.
  • We store artwork on file to enable reorders. You may request deletion at any time.

Our content

  • All content on our website — text, images, logos, design, code — is owned by or licensed to us and protected by Australian and international intellectual property laws.
  • You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.
  • The BRIGHTSHIFT name and logo are trademarks and may not be used without permission.

Your warranties about artwork

You warrant that: - You own all rights to any artwork, logos, or designs you supply, or have all necessary permissions. - Your artwork does not infringe on any third party's copyright, trademark, or other intellectual property rights. - Your artwork does not contain anything unlawful, defamatory, offensive, obscene, or that promotes hate or discrimination.

You agree to indemnify us against any claims, damages, or costs arising from your breach of these warranties.

7. Custom-Made Goods — No Change of Mind Returns

Because every BRIGHTSHIFT polo is custom-printed to your specifications, we do not accept returns or refunds for change of mind after you approve your proof.

8. Delivery and Risk

  • Delivery timeframes are estimates, not guarantees.
  • Risk in the goods passes to you when the carrier takes possession of your order.
  • You are responsible for providing an accurate delivery address. We are not liable for parcels sent to incorrect addresses you provided.

9. Limitation of Liability

To the maximum extent permitted by law: - Our total liability for any claim arising from an order will not exceed the total price you paid for that order. - We are not liable for indirect, consequential, or special losses including loss of profits, business interruption, or loss of goodwill. - Nothing in these Terms limits or excludes any liability that cannot be lawfully limited or excluded, including your rights under the Australian Consumer Law.

10. Warranties and Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

11. Website Use

  • You must not use the website in any way that is unlawful or could damage, disable, or impair the site.
  • You must not attempt to gain unauthorised access to any part of the website or its underlying systems.
  • We may suspend or terminate your access at any time for breach of these Terms.

12. Privacy

Your use of our website and services is subject to our Privacy Policy, which forms part of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our website and services after an update constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising from these Terms or your use of our services.

15. Severability

If any part of these Terms is found to be unenforceable, the remaining parts remain in full force and effect.
